The access to and use of our Site on your part is subject to these Terms of Use and all applicable laws and regulations. To that end, we encourage you to read these Terms of Use carefully, along with our Privacy Policy and Cookies Policy which form an integral part of the present Terms and Conditions and are considered equally binding, before you start using the Site. By using the Site, you explicitly declare that you acknowledge and accept these Terms of Use and agree to conform with them. If you do not agree to these Terms of Use, we kindly ask you to refrain from using our Site. Please note that all references to ‘our’, ‘us’, or ‘we’, ‘our company’, in these Terms of Use refer to DAMASOL LIMITED.

It is highly important that you read our Privacy Policy and our Cookies Policy, as well, in which we describe information about your private data processing. Our company is expressly designated as the Data Controller under GDPR. Visitors / Users grant a non-exclusive license to DAMASOL LIMITED to store and process uploaded content.

The present terms of use may be renewed and modified by DAMASOL LIMITED in whole or in part, whenever this is deemed necessary, for the more complete information of the visitor / user, always in the context of good faith and business ethics, and the visitor/ user must check every time for possible modifications, in accordance with this. The continuation of the use by the visitor / use indicates anew his acceptance of the amended terms, and in case of non-acceptance, the visitor / user must refrain from any use of them.

PROVIDED SERVICES

The Site provides services for purchasing event-related services, creating and distributing invitations, creating a guest list, as well as creating templates for events.

CHARGES

The cost of each service offered through the Site is determined by our company.

PURCHASE PROCEDURE

The service purchase process takes place exclusively via the company's website ethileo.com, in a simple, easy-to-use and secure manner. Navigating the website does not require registration. All necessary information about the offered services is available to the visitor / user.

To purchase a service, the customer needs to register on the platform, which is possible in two ways:

a. using his Google account,

b. using his email address.

Payment for the services is carried out exclusively via Stripe and PayPal. The visitor /user is redirected to the provider’s secure environment, and DAMASOL LIMITED does not store any card details. The visitor /user consents to the transfer of the necessary data outside the EU, where required.

Our company bears no responsibility for payment failures, delays or technical errors attributable to Stripe or PayPal. Refunds or reversals are processed exclusively according to the policies of each provider and our company has no control over such decisions.

PROCEDURE FOR CANCELLATIONS - REFUNDS

Our company does not provide the option of cancellations or refunds.

Pursuant to Article 3ib’ of Law 2251/1994, the right of withdrawal does not apply to digital services which are fully performed before the expiry of the withdrawal period, provided that the consumer has given his prior express consent and acknowledgment of losing the right of withdrawal. By purchasing any service through the Site, the consumer expressly acknowledges that the service is fully performed upon delivery and agrees that the right of withdrawal is excluded.

ACCESS & RESTRICTION OF ACCESS TO OUR SITE

No registration is required to browse the Site. All information about the services, are provided by simply browsing without a special login (log in). On the contrary, in order for the visitor / user to proceed with the purchase of the provided service, he/she is required to login (log in).

Use of the Site is permitted only to individuals over 18 years of age. The visitor / user declares responsibly that he/she is over 18 years old and the information provided is true. Our company shall bear no liability for false declarations relating to age or identity.

Our Site may be available to whoever holds an Internet connection but such access is not considered indefinite. In any case of illegal or contrary to these Terms and conditions of use of the Site, the visitor/user is obliged to compensate our company for any positive and consequential damages.

The non-exercise by the beneficiaries of their rights under these terms and conditions does not imply their waiver of these rights.

PROFESSIONAL PROFILES

Professionals may create a professional profile on the Site for the purpose of presenting and promoting their professional services to visitors and users of the Site. The professional profile may include information voluntarily provided by the professional, such as the professional’s name or business name, professional category, location, description, areas of specialisation, languages, photographs, portfolio material, services offered, indicative pricing, response time and other information made available by the professional for publication.

By submitting information and content for inclusion in a professional profile, the professional acknowledges and agrees that such information and content may be displayed publicly on the Site and may be viewed by visitors and users of the Site.

The professional is solely responsible for the accuracy, legality and lawful publication of the information and content included in the professional profile and warrants that such information and content does not infringe the rights of any third party, including intellectual property, privacy, image, publicity or personal data protection rights.

In particular, where the professional uploads photographs, videos, portfolio material or other content containing or relating to identifiable third parties, the professional is solely responsible for ensuring that all necessary rights, permissions, consents or other lawful grounds required for the publication and use of such content have been obtained.

DAMASOL LIMITED reserves the right, where reasonably necessary and in accordance with applicable law, to refuse, restrict, suspend or remove any professional profile or any content included therein where such content is unlawful, inaccurate, misleading, infringing or otherwise contrary to these Terms or the legitimate interests of DAMASOL LIMITED or third parties.

EXCLUSION OF LIABILITY

We kindly notify that you are making use of the Site at your own risk. Neither we, nor any of other associated party involved in creating, producing, or delivering the Site, are liable for any direct, indirect, punitive, incidental, special, consequential or any other damage arising from or being in any way connected with the use of this Site or content, whether based on contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility of any such damage.

By uploading such content, the user grants DAMASOL LIMITED a non-exclusive, worldwide, royalty-free license to store, reproduce, display and technically process such content solely for the purpose of providing and operating the relevant services, including the publication and display of professional profiles on the Site. The user warrants that such content does not infringe third-party rights and bears full responsibility for any claims arising from unlawful or infringing content.

In case a rights holder believes that any content uploaded by users infringes intellectual property rights, a written notice may be submitted to the company so that the content is removed (“takedown procedure”).
